# What is a non-exclusive license?

A non-exclusive license gives a licensee the right to use data or other property while the owner stays free to use it and to license the same thing to others.

## What does a non-exclusive license mean for a data owner?

It means the same SOPs, documents or code can be licensed to more than one buyer, so one dataset can earn more than once. US copyright law counts an exclusive license as a "transfer of copyright ownership" but expressly leaves out "a nonexclusive license" ([17 U.S.C. § 101](https://www.law.cornell.edu/uscode/text/17/101)), so a non-exclusive grant leaves copyright ownership with you, where the data is protected by copyright at all. Reddit's data shows the pattern: Google gained access to Reddit's Data API in February 2024 ([Google](https://blog.google/company-news/inside-google/company-announcements/expanded-reddit-partnership/)), and OpenAI did in May 2024 ([Reddit](https://redditinc.com/news/reddit-and-oai-partner)).

## Can a non-exclusive license still limit what you do next?

Yes, because "non-exclusive" settles only whether you may license others, and the rest of the grant still applies. micro1's master terms are expressly nonexclusive, yet also irrevocable and perpetual ([micro1, s. 1.2](https://www.micro1.ai/legal/data-license-master-terms)), and the seller warrants it has not already granted anyone rights to "the same Data on the same or substantially similar terms" ([micro1, s. 5.1](https://www.micro1.ai/legal/data-license-master-terms)). That does not bar later licenses, but it makes the order of your deals matter. The same terms stop the buyer reselling the same data "as a standalone data product" ([micro1, s. 1.4](https://www.micro1.ai/legal/data-license-master-terms)), but still let it grant its customers "the same rights in the Data and derivatives of it" ([micro1, s. 1.2](https://www.micro1.ai/legal/data-license-master-terms)), so check how far a buyer can pass your data on before you count on the next license.

## How does a non-exclusive license affect what you are paid?

Each non-exclusive license is usually priced below an exclusive one, because the buyer gets less, but the total across several licenses can be larger. An archive that keeps growing, such as a knowledge base or a repository, can also be licensed again in new tranches. Your company can be paid more than once, through renewals and repeat licences.
